TERMS AND CONDITIONS

Between Diseño y Arquitectura Paula Cortes EIRL, Unique Tax Identification Number 76,602,241-3, hereinafter Paulamar and the User who subscribes and accepts this instrument, it has been agreed to enter into this agreement to use the Website www.paulamar.cl (“Agreement” or “Use Agreement”), which will be governed by the Terms and Conditions indicated below. 

Transactions carried out through www.paulamar.cl are also subject to current Chilean legislation, in particular Law 19,496 on the Protection of Consumer Rights and Law 19,628 on the Protection of Privacy. Acceptance of the Terms and Conditions described below is a requirement for making purchases on the site.

FIRST. Purpose of the Agreement. The purpose of this Agreement is to regulate the terms and conditions that govern the use of the Site, as well as in general the relationships, rights and obligations that will be generated between those involved in the operation of the site.

SECOND. Declarations. The User declares, knows and accepts:

  • That is of legal age.
  • That it is aware of the technological nature of the Site and its content and that, therefore, it is naturally and inherently exposed to interruptions and/or unavailability, which are not necessarily under the control and responsibility of Paulamar.
  • That, given the aforementioned nature, Paulamar may, from time to time, voluntarily affect the availability of the Platform, especially but not limited to, to carry out maintenance, both preventive and corrective, to update its content, to safeguard the security and integrity of the Site or for similar causes or purposes.
  • That the Site uses first-party, own and third-party cookies, of a temporary and permanent nature, which are used to store non-personal identification information of the Users. Acceptance of this Agreement shall constitute unequivocal acceptance by the User for the use of the Site. The User must consult the instructions of his/her browser, especially with regard to settings, where it is possible to choose the functionality that communicates the existence of cookies and/or prevents the installation of cookies. Without access to cookies, the User will not be able to access certain functionalities that the Site has. Consequently, if the User does not have cookies enabled, he/she may not have access to certain tools of the Site or their correct functioning may be affected.
  • It is your responsibility to have antivirus, firewall and/or other similar systems, which must be permanently updated.

THIRD. Formation of consent and modifications. In the case of purchases made through the Site and this Agreement, consent will be formed when the User unequivocally accepts the purchase.

FOURTH. Obligations. The User agrees to:

  • That all information you provide to Paulamr, whether personal or of any other nature, by any means, is true, reliable and verifiable.
  • To keep your personal information always up to date, especially the product delivery address.
  • To know and accept the Privacy Policies.
  • To use the Site, as well as its content, only for purposes that fall within the legal and regulatory framework.
  • Not to distribute from the Site information, messages, posts or content that may be fraudulent, misleading, discriminatory, violent, threatening, harassing, defamatory, derogatory, and in general, that may harm third parties and/or Paulamar. In the event of non-compliance with this obligation, Paulamar will be authorized to remove such information, messages, posts or content from the Site.
  • Not to distribute from the Site without the prior authorization of the owner, information or content that is protected by intellectual property or copyright laws.

FIFTH. Purchase of products on the Site. Purchases may only be made by users over 18 years of age. 

SIXTH. Purchase process. In the event that the User wishes to purchase a product, he/she must add it to the “shopping cart”. Upon accessing the “shopping cart” detailed information about the transaction will be displayed, where the following procedure must be followed to complete the purchase:

  • Enter your email and personal information as requested, and then proceed to the detailed information about the shipment.
  • Select the shipping or pick-up method chosen from the alternatives offered: Home Delivery or Pick-up at the Workshop
  • By clicking the “Finalize order” button, the User will be redirected to the site of the selected payment method, which will be governed by its own terms and conditions, which must be accepted.
  • Once payment has been made, Paulamar will send an email confirming the purchase, which will contain the details of the purchase, the order number and the shipping address.
  • At Paulamar you can pay via webpay plus, and by bank transfer. In the case of choosing bank transfer, if the payment is not completed within 3 hours, your order will be cancelled and the stock will be released.
  • Paulamar will subsequently send additional information by email regarding the status of your order, in terms of assembly and delivery, for optimal tracking purposes.

It is noted that the value of delivery or shipping will be the responsibility of the buyer and will depend on the method of delivery or shipping selected, which will always be informed prior to completion of the purchase.

In the event that the price of a product, due to an involuntary error on the part of Paulamar, is published at a price lower or higher than its actual value, the company will contact the users to resolve the situation in the most appropriate manner and as quickly as possible. In the event that the stock of a product, due to an involuntary error on the Paulamar platform, is oversold, we will contact the User to offer an exchange or make a refund.

SEVENTH. Rules for the dispatch of products.

  • It is the buyer's responsibility to provide an address where there is an adult to receive the delivery at the delivery time.
  • Paulamar will send an email confirming the dispatch on the same day it is made, with information on the courier by which it was sent.
  • Delays caused by the absence of the buyer or a third party authorized to receive the purchase at the time of delivery; by incorrect or incomplete address; by the User's refusal to accept the shipment and change of address will be the responsibility of the buyer.
  • It is not possible to schedule a specific delivery time.
  • Standard shipping: Purchases with payment confirmation before 2:00 p.m. Monday through Friday have a maximum delivery time of 6 business days throughout Chile. 
  • These delivery times may be modified in the context of the CyberDay and CyberMonday events and informed accordingly to customers. For more details, please refer to the updated information in the Shipping section.
  • For shipments to Easter Island and Juan Fernández, the User must contact us directly via Whatsapp +56984498876

EIGHTH. Rules for In-Store Pickup

  • When making the purchase, the User may select Pick-up at the Workshop located at Calle Puerta del Sol 151, Las Condes commune, or at the Providencia Pick up point, located at Diagonal Oriente 1850, Providencia.
  • Paid and confirmed purchases can be collected once the User has received the withdrawal confirmation email, which may occur within 2 or 3 business days from receipt of the first email confirming the purchase. The customer will not be able to collect their order before receiving the aforementioned email.
  • These delivery times may be modified in the context of the CyberDay and CyberMonday events and informed accordingly to customers. For more details, please refer to the updated information in the Shipping section.
  • The User will have a period of 7 working days to collect their purchase from the Workshop. After this period, a new time window must be coordinated to make their purchase available.  For these purposes, Paulamar will contact the User to coordinate delivery/pickup.

  • The User will have a period of 30 business days to collect his/her purchase from the Workshop. After this period, the purchase will be cancelled and will be void, and a refund of the price paid will be arranged. For these purposes, Paulamar will contact the User.  to obtain the bank details, and it is the latter's responsibility to provide reliable information so that the transfer is carried out successfully. In the event that the buyer does not provide the bank details, Paulamar will not incur any liability for failure to refund the price.

NINTH. Discounts.

Paulamar may, from time to time, grant discounts in the form of codes that the User may apply to his or her purchase. Paulamar will determine the maximum amount and conditions of the discounts that the User may use on a purchase and will detail this on the Site. The discounts used by the User will not be reimbursed in the event of the return of the products, for whatever reason.

All offers and promotions contained on the Site will remain valid as long as stock is available or are not modified by Paulamar and reported on this site.

In the case of offers, discounts or promotions, the amount paid during the promotion will be respected. Product returns do not include the shipping cost, only the cost of products. If you wish to make an exchange, the User will be entitled to the amount paid during that promotion. Return shipping costs are the responsibility of the User.

TENTH. Warranties and After-sales.

The User will have the right to unilaterally terminate a purchase, under the terms established in article 3ºbis of law 19.496, which establishes standards for the protection of consumer rights.

For all purposes, the User must keep the receipt or proof of payment.

  • Right of withdrawal: The User may return a product purchased on the Site within 10 days of receipt, without having to invoke any reason and provided that the product is in perfect condition with its original seals intact, in order to obtain a refund. The right of withdrawal may not be exercised when the good, subject of the contract, has been damaged due to an act attributable to the buyer. Refunds are made within 7 days via transfer.
  • Product exchange: The Consumer has the right to exchange a defective product in the event of a fault, and to its legal guarantees, in accordance with the Law on the protection of consumer rights, for 30 days after making the purchase. It is an essential requirement for the exercise of this right that the product has not been damaged by an act imputable or attributable to the user, which will be verified by Paulamar, within a review period of 10 business days from when the product is received by the Store.

  • The products that make up the category of --SAMPLE SALE-- correspond to samples from previous seasons and are not subject to changes or returns.

ELEVENTH. Privacy Policies. The information provided by users will be stored under high security standards, treated in accordance with the Law for the purpose of completing transactions on the Site and improving the work of information and marketing of the products offered. Under no circumstances may they be communicated or transferred to third parties not related to Paulamar. The User may exercise their rights to information, rectification, cancellation and/or blocking of their personal data when they deem it appropriate, in accordance with the Law.

The User authorizes Paulamar to use the data provided by him/her to allow the correct operation of the site, and especially, to communicate them only to the companies in charge of the dispatch, as well as to those that process the payments, all of this, in the terms permitted by Law 19,628, on the protection of personal data.

Likewise, you authorize Paulamar to send you emails and/or text messages with information related to the services provided through the site, and you may always revoke this authorization.

Paulamar has a Customer Service area, through which it will receive and channel Users' queries and complaints. For these purposes, the User must channel their communications to the email account hola@paulamar.cl

TWELFTH. Security. Paulamar maintains high security standards when purchasing products based on TLS 1.2 cryptography, which ensures both the authenticity of the site and the encryption of all information provided by users. In the event of difficulties that prevent or delay the purchase of products, Paulamar will adopt the necessary measures, in accordance with the technological means available, in order to normalize the continuity and operation of the site.

In the event of any irregularity in the transactions carried out by the User through this site, Paulamar may contact the User by telephone or email in order to corroborate the User's data and try to avoid possible fraud. If contact cannot be established within twenty-four hours after the purchase has been made on this site, the purchase order will be rejected and cancelled.

THIRTEENTH. Validity. This agreement, while the Site is available, will be valid indefinitely, unless Paulamar exercises its discretionary power to terminate it, in which case the User will be duly notified by any reliable means.

FOURTEENTH. Applicable law and domicile. This Contract shall be governed by Chilean law. The parties establish their domicile for all legal purposes in Santiago de Chile, and submit to the exclusive jurisdiction of the ordinary courts of justice with jurisdiction in said commune.
